Ben Johnson is a founding partner and the Managing Partner of Avodah Legal, PLLC, where he also serves as Chair of the firm's Labor & Employment Team. He represents businesses, executives, physicians, and individuals in complex workplace matters, and he is frequently relied upon by other attorneys as a trusted referral and litigation resource for high-stakes employment disputes and sensitive advisory work.

  • Ben's practice spans the full range of labor and employment law, including corporate compliance, discrimination and retaliation claims, whistleblower actions, wage and hour disputes, civil rights litigation, and employment contract negotiations. He regularly litigates in state and federal courts and advises senior leadership on compliance, risk management, and strategic employment decisions. Clients—particularly executives, physicians, and closely held businesses—value Ben's ability to deliver clear, practical guidance when legal risk, professional reputation, and organizational priorities intersect.

    Before co-founding Avodah Legal, Ben was a partner at a mid-sized law firm, where he chaired the Labor & Employment practice and handled the firm's most complex employment matters for both employers and individuals. His work has been consistently recognized by peers and publications, including Virginia Super Lawyers, Coastal Virginia Magazine, and Virginia Business.

    Ben brings a judicial perspective to his practice informed by early experience clerking in the federal courts, where he worked closely with judges on a wide range of legal issues, many involving employment and civil rights law. He is a magna cum laude graduate of the University of Richmond School of Law, a published author in the University of Richmond Law Review, and has made multiple media appearances discussing developments in employment law.

    Outside of his legal practice, Ben enjoys running and has completed three marathons. He also plays piano and is an amateur photographer. Ben attends Redeemer Anglican Church in Richmond and lives in the city with his wife and three daughters. 

    REPRESENTATIVE EXPERIENCE:

    Whistleblower & Retaliation:

    • Secured a significant civil fraud settlement in FCA qui tam whistleblower litigation arising from a multi-agency investigation involving the U.S. Attorney's Office, FBI, and Department of Defense Office of Inspector General.

    • Served as lead counsel in federal FCA whistleblower retaliation litigation against a national defense contractor.

    • Represented physicians and senior executives in state and federal whistleblower retaliation matters involving reports to regulatory and licensing bodies.

    Litigation and Dispute Resolution:

    • Secured a federal judgment against an international defense contractor on disparate treatment and retaliation claims under Title VII and 42 U.S.C. § 1981.

    • Defended a large regional hospital system against federal discrimination claims in the U.S. District Court for the Eastern District of Virginia.

    • Represented and advised physicians, surgeons, members of medical leadership teams, and other medical providers in employment civil rights, whistleblower, and other legal disputes, as well as contract negotiations and licensing investigations.

    • Served as lead counsel in multiple federal religious discrimination matters across jurisdictions.

    Wage & Hour:

    • Represented plaintiffs in FLSA collective actions in multiple federal courts, achieving favorable outcomes.

    • Defended employers in FLSA collective action litigation and advised organizations on employee classification, wage practices, and compliance.

    Public Sector & Government Employment:

    • Served as lead counsel on appeals before the Merit Systems Protection Board and the U.S. Court of Appeals for the Federal Circuit.

    • Represented and advised federal and state employees—including medical providers, engineers, educators, and military personnel—in disciplinary, investigative, and civil rights matters.

    Contracts & Compliance:

    • Represented executives and professionals in high-stakes contractual disputes involving confidentiality, compensation, and restrictive covenants.

    • Advised employers, independent contractors, and organizations on policy development, wage structuring, and regulatory compliance.
